www.3dmodelunity.com, the "Website", is owned, published, and maintained by or on behalf of 3DM di Mario Di Gesaro ("3DM"), a company incorporated under the laws of Italy, with registered office at via San Romanello 26, 20153 Milano, Italy, fiscal code DGSMRA80D02G752F and VAT number 10931850969, represented by Mr Mario Di Gesaro.

3DModel Unity is an online store for 3D and 2D models, materials for CAD and render software and other digital items (the "Models").

When you navigate the Website and purchase from our online store, you agree to the present Terms and Conditions, which may be updated from time to time. Please check this page regularly to be informed of the latest version.

1. Access and accounts

3DModel Unity is a website accessible to all. We reserve the right to limit some accesses and some rights on the Models to users who undertake a subscription, purchase credits or perform other types of payment. Please visit the Website regularly to discover the current offers and plans.

You can purchase as a guest: in that case an account is automatically created from the email address you provide at checkout, so that you can access your invoices and download your files again at any time. You are responsible for keeping access to your account email secure.

3DModel Unity reserves the right to trace, complete, change or erase contents, graphics, programs, Models, products or data for necessary maintenance or any other reason, without this interruption of service subjecting 3DModel Unity to any obligation to compensate for it.

2. Payment

Payment is handled safely by PayPal (Europe) S.a r.l. et Cie, S.C.A. ("PayPal") or other companies of the same group, pursuant to their terms and conditions, which are made available to you at the time of payment. PayPal accepts PayPal accounts and major credit/debit cards. 3DModel Unity is not responsible for the handling of payment by PayPal.

Prices are displayed in Euro (EUR) or US Dollars (USD) depending on your location; the currency actually charged is shown at checkout before you confirm the payment. Receipts are issued in Euro.

You will receive a receipt or invoice for your payments via email; receipts and invoices are also available in the account pages of the Website.

3. Intellectual property rights

All copyrights, trademarks, logos, designs, website structure, images and other rights, including intellectual property rights on the Models and on the Website, belong to 3DModel Unity or its licensors; none of these rights are assigned or transferred to the end user. All rights not expressly granted herein are reserved.

Product names, brand names and designer names shown in the catalog belong to their respective owners and are used to describe the subject of each Model. Models flagged "Real Product" reproduce real products available on the market: the flag refers to the physical product, not to an endorsement or certification by the brand.

4. License

If you fulfil the requirements indicated on the Website, including any payment requirements, you are granted a license to use the purchased Models in the available formats. Each product page shows which license applies: an Editorial License (most products) or a Full License (selected brand partners). The complete terms of both licenses are described on the Licenses page, which forms an integral part of these Terms and Conditions.

In all cases you may not:

• distribute, publish, sell, assign, transfer or otherwise redistribute the Models in the form of a 3D or 2D model, 3D scene, material or texture, or as part of a scene, animation or any other format from which a Model or any part of it may be separately exported, extracted or decompiled into a redistributable form;
• include the Models in asset packs, stock libraries, model marketplaces or datasets used to train artificial-intelligence models;
• remove any copyright notice, trademark or other proprietary right from any place where it is present or incorporated into the Model;
• use the Models for illegal, unethical or immoral purposes, or for purposes that would violate the rights of others or the reputation of 3DModel Unity or its licensors;
• sell or distribute modified versions of the Models as your own: although you may modify the Models so that they conform to your needs, such modifications remain derivatives of the original and are subject to this agreement.

Some Models may be subject to additional limitations deriving from the license that 3DModel Unity has obtained from its licensors. If any, such limitations are made known to you in the specific Model section of the Website. You undertake to respect those limitations and shall keep 3DModel Unity indemnified and harmless in case of non-respect.

5. Refund policy

You understand and agree that the execution of the license starts as soon as you download any Model. Given that the Model qualifies as digital content supplied on a non-material support, there is no right of withdrawal on downloaded Models, in conformity with article 59 of the Italian Consumer Code.

At our own discretion we may refund you, in download credits or through the original payment method, in case of a damaged file (e.g. missing textures, corrupted geometry): although all products are thoroughly tested before release, unexpected errors may occur. The full procedure is described in our Refund Policy. Refund requests can be sent to refunds@3dmodelunity.com together with the reasons for the request.

6. Warranty and limitation of liability

The Models are provided "as is", including defects, if any, and without any warranty, representation or condition of any kind, including fitness for purpose, technical requirements, format or compliance with third-party rights.

We use all reasonable endeavours to ensure quality access to the Website, but we do not guarantee its continuous operation, which may be interrupted for maintenance reasons. We cannot be held responsible for malfunctions or failures of the network, servers or any other technical malfunction beyond our reasonable control that would prevent or alter access to all or part of the Website, nor in the event of force majeure as defined by the applicable regulations.

We draw your attention to the limitations and constraints specific to the Internet and to the impossibility of guaranteeing the total security of data exchanges. It is your responsibility to take all necessary measures to protect your information system against unauthorized intrusions, in particular by securing your Internet connection and by using appropriate anti-virus software. The quality of the Website's operation, and in particular response times, may vary according to the individual settings of your connection and Internet access service; we do not assume any responsibility in this regard. Likewise, we do not take responsibility for any malfunction of the Website resulting from misuse by you or from the inadequacy of the hardware and software you use.

7. Subscriptions, credits and renewal

If you purchase a subscription plan, credits or another payment option as indicated on the Website and specified in the invoice or receipt, you agree to pay the fee specified in the invoice at the time specified in the invoice. Duration and possible renewal are indicated on the specific page of the offer you are subscribing to. Once renewed, your license will be in effect according to the terms and conditions applicable and available on the Website on the day before your renewal date.

If the method of payment provided by you is no longer valid, you must provide a new form of payment within five days of notification; failure to do so may result in the suspension or termination of your account. Such suspension or termination will not affect your obligations accrued until that date. A subscription plan requires stored payment information, which will be used to pay for the subscription and for Models purchased outside the subscription. A subscription plan is non-transferable and may not be used by any third party except the licensee.

8. Unauthorized use and termination

Any use of the Models in a manner not expressly authorized by these Terms and Conditions constitutes a breach and entitles us to exercise all rights and remedies available to us. You shall be liable for any damages resulting from such infringement, including any claims by third parties.

9. Applicable law and jurisdiction

These Terms and Conditions are subject to Italian law. Any dispute that cannot be solved amicably shall be brought before the courts of Milan. Consumers residing in the European Union retain the protections granted by the mandatory provisions of the law of their country of residence; the EU online dispute resolution platform is available at ec.europa.eu/consumers/odr.
